Truck companies must provide safe equipment and sufficient training

Sometimes it’s not a matter of how smart a person is, but rather how well-trained they are.

Consider the case of the truck driver who was crushed and killed between the frame and “dump box” of his truck. When the safety "overtravel" cable between the truck’s frame and dump box malfunctioned after getting caught on a protrusion, thereby stopping the dump box from being raised fully, the driver emerged from the cab of the truck and freed the cable … and allowing the dump box to come crashing down on his head.

Initial reactions might be less than sensitive, but when the Occupational Safety and Health Administration (OSHA) conducted its truck accident investigation into the incident, it determined that the driver was not solely to blame.

The victim in the case, OSHA ruled, “had not received training or instruction in proper operating procedures and was not made aware of all potential hazards in his work. After inspecting the scene, OSHA “issued one citation for one alleged serious violation of its construction standards. Had the required training been provided to the employee, this fatality might have been prevented.”

The OSHA report got straight to the heart of what could be a truck accident lawyers’ case, because while the accident might seem to be a matter of carelessness on the part of the victim, failure to provide a safe work environment — including sufficient training for all procedures and equipment — may be perceived as trucking company negligence. Further, the malfunctioning safety "overtravel" cable would likely be the result of either defective truck equipment supplied by the truck's manufacturer or failure to maintain the truck on the part of the trucking company.

First Look: 2012 Porsche Panamera GTS

Porsche has added yet another member to the Panamera range, in the form of the GTS. Based off of the Panamera 4S, the GTS features a modified version of the S/4S?s 4.8-liter V-8, which produces an extra 30 horsepower (430 horsepower compared to 400 in the Panamera S/4S). Torque is up 15 pound-feet as well. Power is delivered to all four wheels by way of Porsche?s seven-speed PDK (or Doppelkupplungsgetriebe if you sprechen Deutsch). 0-60 miles per hour happens in a brisk 4.3 seconds, while the top speed sits at a lofty 178 miles per hour.

FedEx Sends 114 Drivers to Compete in The National Truck Driving Championships

FedEx reports one hundred and fourteen drivers from 45 states representing FedEx will compete in the National Truck Driving Championships (NTDC) in Columbus, Ohio, August 3-7.

According to FedEx, each driver earned the right to compete in the NTDC by qualifying at state-level truck driving championships. The American Trucking Associations (ATA) sponsors the NTDC, which is designed to recognize industry leadership in safety and to promote professionalism among truck drivers.

"Every day, the thousands of professional drivers and contractors who comprise the FedEx driving force strive not only to deliver shipments on time but also to ensure that safety continues to be their most important priority," said Frederick W. Smith, chairman, president and chief executive officer, FedEx Corp. "This collective commitment of our driving force to safely share the road with other motorists each day has been validated by the performance of the more than 1,400 FedEx drivers, couriers and contractors who competed in their respective state truck driving championships and the accomplishments of our 114 NTDC competitors in particular."

Quick Drive: 2011 Cadillac CTS

I?ll admit, based on my experiences behind the wheel of the Cadillac CTS-V, I expected a little bit better from the V-6-powered CTS. It wasn?t that I was disappointed by its abilities as a luxury sedan, or by the level of equipment, but that from a handling perspective the CTS-V was so much better than our tester.

Keeping Pace with Change

Most of us have been impacted in some way, shape, or form over the last five years by a steadily accelerating technological revolution.  Begun in the '60's and '70's with the rise of mainframe computers, transforming in the '80's with the personal computer, again in the '90's with the wide spread use of the internet, and now, in the early 21st century, transitioning with the adoption of the smart phone, the technological advances have moved even the most mundane tasks to an electronic medium.

Here at CommercialTruckTrader.com we've watched this transition since the mid '90's when we first launched the TraderOnline.com family of websites.  At that time, our magazines were mid-stride, being very lucrative for the company.  As the decade moved on and later into the '00's, we saw dramatic declines in content and distribution.  Fewer people wanted to advertise in the magazines and fewer people were picking them up in their local 7-11's.

It forced us to re-envision ourselves.

We've learned that to keep pace with change, we have to be willing to entertain ideas that just a few years ago wouldn't have seemed necessary.  It's easy, however, to get caught up in the tide, always looking for the next-best-thing and never really finishing what you already have underway.  In web-culture, we refer to this as the "Oooo!  Shiney!" complex.  It appears as hot new versions of software or hardware that make existing applications look dull and mundane.  Or it might be that new ways of managing employees and resources challenge decision makers on what it looks like to run a modern business.  The advances are permeating everything we do.

So how do you temper this as a business leader or as an employee trying to enact change?  Those two sides of the coin can come into conflict easily and readily.  A company that has functioned well with a product or policy may find requests to consider changing the product or policy frustrating.  "If it has worked so well, why should we change?" they'll ask.  Meanwhile, the advocates for change will feel the well-functioning product or policy will soon be eclipsed by more innovative elements in the marketplace.  "How can you expect to remain competitive if you're unwilling to adapt?" they'll ask.

Advocates of change need to keep this in mind:  when you encounter more resistance to your ideas than anticipated, change tactics and slow down.  You are likely moving too fast and need to adjust to an informational campaign.  Aim for a lower goal if you cannot enact all of the change you're looking for.  People you're approaching may not be as prepared to even consider an adaptation as you are.  Give them time and don't ever make it personal.

Those being asked to change need to consider that advocates are typically pushing because there is a perceived benefit that comes with making the change.  They're not doing it to be frustrating, but to improve a situation, whether it is a product or a policy.  This means you should work on getting down to those benefits.  Ask for the supporting data, objectively consider, but don't ever dismiss an idea.

I've been as guilty of both of these points, as I would imagine anyone else would be.  I've been recalcitrant, not wanting to entertain a significant change to the way I worked, as well as having been the pusher, trying too hard to enact something new when the division wasn't ready.  It's been reflections on these points that have led me to writing this post.

Not all change is good or beneficial and one should never "fall in love" with something they've advocated.  We've made this mistake many times and a recent example is with our new search product.  We introduced a reloading method which we felt would reduce load times, but the feedback was mostly negative about this aspect, causing a jarring transition when going to a new page.  We had to suck it up, so to speak, and revert that element.  Feedback has since improved, showing that a smart technological adaptation was not a smart user experience adaptation.

Be willing to consider and adjust due to the data available to you.  Consider not how much adaptation will change what you do, but consider what opportunities lie on the other side of that adaptation along side the cost of making the adaptation.  Be willing to consider even if it is something you are not personally comfortable with!

We live in a world changing so fast it seems implausible.

  • Facebook has gone from 12 million users in 2006 to 500 million users in 2010.  
  • The iPhone was launched in June, 2007.  It is only 4 years old.
  • In February there were ~69 million smartphone users in the United States, or about ~75 million today if the growth trend of ~10% per quarter continues.
  • In 14 months, Apple sold 25 million iPads.
  • The average American 15 year-old is not likely to remember life before Google.
  • The average American 20 year-old may not remember life before the internet.
The technology world is swirling around us and we must smartly keep pace with the changes, making informed decisions and being open to suggestions.  Remember, if resistance is greater than anticipated, change tactics and slow down.  If someone is pressing for change, ask for the data and the details to understand why.

Medicine Park

Deb was wrestling a bit with three border collies Saturday while Laura and Blake were making a trip down to Houston.  I helped wear them out early that morning with a long walk, so Deb could could have it a bit easier when I left for the ride.  That put me a little behind on meeting up with the LSBMWR group leaving out of Aubrey.  But it did not take long before I heard Herman's voice on the radio.  He and Thomas had held back while Mike was topping off his tank.


I joined up with them, and we finally caught up with Leonard's main group around the Oklahoma border.

The wind was blowing like crazy from the south, so it wasn't too bad as we rode north, but those east-west stretches were a challenge.


The rest place was in Wilson, where all ~25 bikes converged.


The trees were changing colors nicely for fall.
 
We stopped at the Meers Store in the Wichita Mountains for an awesome burger.  This place has been around since 1901.

 
 
It was not a long ride to Medicine Park.  Everybody settled into their accommodations, and then went back out for a ride through the wildlife refuge and up to the peak of Mt. Scott.

 
We all met for dinner at The Plantation.  The food was great as was the service.  Ghazi and Hani modeled riding suits manufactured by their company, Teiz Motorsports.  They are an energetic young couple, and I wish the best to them and their venture.  I'm planning to check further into one of their suits.

I wanted to get an early start back Sunday morning.  Thomas already was in for the 7:30 start.  Charlie thought a bit, and decided to join.  As we were warming the bikes, Steve was a taker as well.


There was some kind of cross country event north of Muenster with many dirt bikes and colorful riders.

 
 
The four of us had a good ride back with a fuel and rest stop in Muenster.  As we neared the metromess, we parted ways for the best route to our homes.

This was a nice quick weekend trip to a place that I had no idea of having so much character.  The Lone Star BMW Riders ride committee did a great job in planning for this trip.  Deb's ready to go back with me.
